• Magee Ranch Property Residential Development

  • The application consists of a proposal by SummerHill Homes to rezone and subdivide a 410-acre site into 70 single-family lots, with approximately 287 acres of open space, located southeast of Diablo Road and Green Valley/McCauley Road.

    The Draft Environmental Impact report (DEIR) has been released for public review, and is available for download. Printed copies may be reviewed at the Danville Public Library (400 Front Street) and at the Danville Town Offices (510 La Gonda Way). The DEIR public review period runs for 60 days, to account for the holiday season, from November 30, 2012 through January 29, 2013.

    The Planning Commission will hold a public hearing to receive public testimony on the Draft EIR in early 2013. Notice of the date of this hearing will be provided when it is determined.     The Danville Planning Commission reviewed the final EIR and development application by SummerHill Homes related the Magee Ranch property during their meeting on Tuesday, April 23rd. The application proposes to develop 69 single family homes on the 410 acre site. The homes would be clustered on approximately 38 acres of the site, and the remaining 372 acres would be preserved as permanent open space.At this meeting, the Commission listened to public testimony and deliberated on the project.     On Wednesday September 26, 2012, SummerHill Homes submitted revised plans for the SummerHill Homes/Magee Ranch development application. The revised vesting tentative map shows a reduction of total lots from 78 to 70. The eight homes that have been removed from the plan are within the western portion of the property, including the five production lots across from Fairway Drive and three custom lots in that vicinity.     Due to a delay in the completion of several studies/reports to be incorporated into the draft EIR for the project, the tentative schedule for the release of the draft EIR and review of the project has been revised. The draft EIR is now expected to available for public review in July 2012, and public hearing on the final EIR and the project are projected to occur in early 2013.     In order to provide the most complete report possible, the completion date for the draft Environmental Impact Report (EIR) being prepared for the Magee Ranch/SummerHill development application has been extended to early spring 2012. The request for comments notified the public that the Town was in receipt of the subject application, and solicited feedback on the design of the proposed project.   •  What does review of a Development Application entail?

    The Town must review a development proposal for its consistency with the Town’s General Plan and any other applicable Town Ordinances and guidelines. The Town must also study and understand the potential environmental impacts of the proposal so that an informed decision regarding the proposal can be made. The Town also coordinates with other agencies such as the San Ramon Valley Fire Protection District, Contra Costa County Transportation Department, and East Bay Regional Parks District to address any concerns they may have.  Finally, the Town must insure that the public review process is followed so that all interested parties have an opportunity to participate in the process.

     What is a Development Application?

    Prior to the subdivision and development any land within the Town, the Town requires that the property owner or applicant file a development application with the Town’s Planning Division. The submittal of the development application triggers the Town’s review of the proposed project and requires that the proposal follow a public hearing process. 

     What is an Environmental Impact Report (EIR)?

    An Environmental Impact Report (EIR) is a planning document which evaluates the potential environmental impacts associated with a project. Typical impacts may include: traffic, air quality, noise, public services, biologic resources, water quality, visual impacts, and land use, among others. The EIR discusses these impacts and determines which ones are significant. It also describes mitigation measures to reduce the impacts to an appropriate or acceptable level, where possible.

     What opportunities will I have to comment on the proposed project and/or the Environmental Impact Report?

    Any interested party, organization, or agency may comment on the project/EIR at any time during the Town’s review process. Formal opportunities to comment on the project/EIR include: upon the Town’s mailing of the Request for Comments; upon the Town’s mailing of the Notice of Preparation of the draft EIR; upon the Town’s mailing of notice of public review period for the draft EIR; at the noticed Planning Commission and Town Council public hearing.
